What this covers
- Title search and due diligence reports
- Sale deed, gift deed and lease drafting
- Mutation and record-of-rights correction
- Landlord and tenant disputes, eviction
- Complaints before the RERA Authority
- Boundary, easement and encroachment disputes
Most property litigation is avoidable. It arises because a document was signed before the title behind it was examined, or because a mutation was never completed, or because a family arrangement was agreed but never reduced to writing. The cheapest work in this area is the work done before money changes hands.
Due diligence
A title investigation traces the chain of ownership over the statutory period, examines the record of rights, checks for encumbrances, pending litigation, tenancy claims, and where relevant the position under the West Bengal Land Reforms Act. The output is a written opinion that states plainly what is clear, what is doubtful and what should not be relied upon.
Documentation
Deeds, agreements to sell, development agreements, leases, gift and partition deeds are drafted to reflect what the parties have actually agreed, with attention to stamp duty and registration requirements so that the document is admissible when it matters.
Disputes
Where litigation is unavoidable we appear in title suits, partition suits, injunction proceedings, eviction cases and proceedings before land and revenue authorities, as well as complaints against promoters before the real estate regulatory authority.
