Employment disputes are asymmetric: the employer usually holds the documents and the employee usually holds the deadline. We appear for both sides and the approach is the same in each — establish the documentary record early, then work out what the relevant statute actually entitles the party to.
For employees
Termination without enquiry, non-payment of dues on separation, denial of gratuity, forced resignation and workplace harassment are the matters we see most often. Time limits under the Industrial Disputes Act and the Payment of Gratuity Act are short, and acting quickly materially changes what is available.
For employers
Most employer-side exposure comes from process rather than substance — an enquiry that was not fair, a standing order that was never certified, an internal committee that was not properly constituted under the POSH Act. We advise on documentation and procedure so that decisions taken are defensible.
