A Will that is clearly drafted, properly attested and kept where the family can find it prevents a category of litigation that is otherwise almost guaranteed. Much of our work in this area is preventive.
Drafting
We draft Wills that identify property precisely, appoint an executor, deal with residue, and are attested in the manner the law requires. Where the testator's capacity may later be questioned, we advise on contemporaneous medical certification and registration.
Probate and administration
Applications for probate, letters of administration and succession certificates are prepared with the schedule of assets, valuation and citations that the court will require, and we appear in caveat and contested proceedings where the Will is challenged.
Disputes
Where succession is contested — an unregistered Will, a disputed relationship, property transferred during the lifetime of the deceased — the matter is taken up as a title or partition suit with the necessary declaratory relief.
